COURT

Justin D. Allen, 33, of Schenectady, was sentenced June 29 to 3.5 years incarceration, and 2 years post-release supervision, after pleading to criminal possession of a controlled substance, in connection with an incident in Wilton. 

Destiny Ozani Matari Ramirez, 24, of Albany, was sentenced to 5 years of probation, after pleading to attempted burglary in the second-degree, in connection with an incident in Galway. 

Martin P. Heeney, 58, of Ballston Spa, was sentenced June 30 to 5 years of probation, after pleading to criminal possession of a weapon in the third-degree. 

Victor Casado, 29, of Saratoga Springs, was sentenced June 28 to serve 1 to 3 years incarceration, after pleading to criminal possession of a weapon in the third-degree. 

Samuel Tyrel, 22, of Saratoga Springs, was sentenced June 28 to 1 to 3 years incarceration, after pleading to failure to register as a sex offender. 

Robert Kitchen, 55, of Mechanicville, pleaded June 28 to attempted sexual abuse in the first-degree. Sentencing Aug. 13. 

Isaiah M. Macault, 24, of Albany, pleaded June 28 to robbery in the second-degree in connection with an incident in Moreau. Sentencing Aug. 20. 

James T. Love, 47, of Wilton, was sentenced June 25 to 1 year incarceration in connection with second-degree attempted assault charges, and 3 to 9 years in connection with third-degree arson charged, to run consecutively. 

Lacey Utter, 22, of Broadalbin, pleaded June 30 to criminal contempt in the first-degree, in connection with an incident in Milton. 

Eric J. Buell, 37, of Gansevoort, pleaded June 23 to felony DWI, in connection with an incident in Wilton. Sentencing Aug. 18. 

Neil Devoe, 18, of Troy, was sentenced June 23 to 2.5 years in state prison, and 10 years post-release supervision, after pleading to rape in the second-degree, in connection with an incident in Mechanicville in October 2020. 

Devan D. Hildebrandt, 29, was sentenced June 23 to 1 year jail for each count to run concurrently, after pleading to two counts of burglary in the third-degree, in connection with an incident in Saratoga Springs. 

Justen S. Roberts, 24, of Cohoes, was sentenced June 22 to 2.5 to 5 years in prison and 1 year local concurrent, after pleading to burglary in the third-degree, in connection with an incident in Waterford. 

Matthew J. Stephens, 20, of Wilton, was sentenced June 22 to 60 days in county jail and five years of probation, after pleading to grand larceny in the fourth-degree, in connection with an incident in December 2020.

Shamika Penn, 31, of Buffalo, was sentenced June 22 to time served and five years of probation, after pleading to grand larceny in the fourth-degree, in connection with an incident in Moreau. 

Frank J. Flinton, 33, of Ballston Spa, was sentenced June 22 to 6.5 years plus 2 years post-release supervision, in connection with charges of criminal sale of a controlled substance in the third-degree, regarding incidents taking place in the town of Saratoga and the town of Wilton June 3 to July 15, 2020, and 1 year incarceration on charges of disseminating indecent materials to minors in the first-degree.   

Erik J. Klebauskas, 44, of Wilton, was sentenced June 21 to five years probation, after pleading to aggravated DWI with a child. 

POLICE

Joseph Deschenes, 50, of Saratoga Springs, was charged June 21 with misdemeanor criminal trespass.

Chad Lang, 47, of Saratoga Springs, was charged June 22 with misdemeanor criminal trespass and felony burglary. 

Justin Zayas-Sanchez, 21, of Saratoga Springs, was charged June 23 with criminal mischief as a felony. 

Jordan Garafalo, 38, of Saratoga springs, was charged June 25 with felony assault, and the misdemeanors: criminal mischief, menacing, criminal contempt, criminal possession of a weapon, harassment, act in manner injure child. 

Vincent L. Avila, 22, of Schenectady, and Michael T. May, 25, of Mechanicville were charged June 24 in connection with an incident that occurred in a hotel in Malta on July 4, 2020. The incident was reported in April of 2021 and the investigation resulted in allegations that May hosted an overnight party from July 3, 2020 through July 4, 2020, at which he provided alcohol and marijuana to minors and where there was also sexual activity being conducted, according to the Saratoga County Sheriff’s Department. It is further alleged that at the party, Avila had oral sexual contact with two females, one 16-years-of-age and one 17-years-of-age at the time. Avila is charged with one count each of Criminal Sex Act and Sexual Abuse as well as Endangering the Welfare of a Child and Unlawfully Dealing with a Child. May, is charged with one count each of Endangering the Welfare of a Child and Unlawfully Dealing with a Child.
