Saratoga County Bar Association Presents the Hon. James A. Murphy, III with the George E. Toomey Award

SARATOGA SPRINGS — At its annual holiday dinner, the Saratoga County Bar Association on Dec. 19 presented the Hon. James A. Murphy, III, Saratoga County Court Judge, with the George E. Toomey Award.

Judge Murphy retired at the end of 2024 after a long and distinguished career in public service.

In 1988, Murphy joined the Saratoga County District Attorney’s office where he served 25 years as a prosecutor. He was first elected district attorney in 1997 and was sworn in on January 2, 1998, becoming one of the youngest district attorneys in New York State. He successfully ran for re-election in 2001, 2005, 2009 and 2013. 

Judge Murphy was elected to serve as Saratoga County Court Judge on Nov. 4, 2014, and subsequently presided over felony jury trials and complex civil litigation. He has also served as Acting Justice of the Supreme Court, a position to which he was appointed by Chief Administrative Judge Lawrence Marks in 2017. 

George E. Toomey was an attorney who practiced in Saratoga Springs for many years who dedicated his life to public service. The SCBA named the award in his honor and it is bestowed upon a distinguished member of the bar who has carried on George Toomey’s legacy of commitment to the practice of law and to public service.

Saratoga County Court 

Michael J. Demartino Jr., 42, of Stillwater, was sentenced to 365 days incarceration, after pleading to burglary in the third-degree, a felony, charged March 2024 in Clifton Park.  

Glenn A. Davis, 24, of Schenectady, was sentenced to 1-1/3 to 4 years incarceration, after pleading to burglary in the third-degree, and criminal contempt in the first-degree, charged April 2024 in Halfmoon. 

Clint J. Clark, 51, of Cohoes, was sentenced to 10 months incarceration, after pleading to felony DWI, charged December 2023 in Waterford. 

Luke P. Margison, 46, of Clifton Park, was sentenced to 10 years incarceration/ 15 years post-release supervision after pleading to criminal sexual act in the first-degree; 10 years incarceration/ 15 years post-release supervision after pleading to attempted rape in the first-degree; 7 years incarceration/ 15 years post-release supervision after pleading to sexual abuse in the first-degree, and 1-1/3 to 4 years incarceration after pleading to possession of sexual performance by a child. Sentences to run concurrently. Charged Jan. 1, 2020 in Clifton Park.  

Matthew J. Murry, 41, of Gansevoort, was sentenced to 6 months incarceration/ 5 years probation, after pleading to felony vehicular assault, charged August 2024 in Wilton. 

Jerome Graham, 62, of Ballston Spa, was sentenced to 1-1/2 years incarceration / 1 year post-release supervision, after pleading to attempted criminal possession of a controlled substance in the fifth-degree, charged March 2024 in Ballston Spa. 

Week of December 20 – December 26, 2024  

Saratoga  County Court 

Elizabeth A. Ladd, 43, of Wilton, was sentenced to 5 years probation, after pleading to felony DWI, charged May 2024 in Ballston. 

Frank S. McFarren, 42, of Granville, was sentenced to 5 years probation, after pleading to attempted criminal possession of a controlled substance, charged January 2024 in Saratoga Springs. 

Saratoga County Sheriff’s Office “Actively Investigating” Reports of Drone Activity in Saratoga

BALLSTON SPA — Following reports received of local drone activity, the Saratoga County Sheriff’s Office announced it is actively investigating the incidents in coordination with state and federal partners. 

“At this time, there is no evidence to suggest that the drone sightings pose an ongoing threat,” according to the statement, released Dec. 13. 

In November, witnesses began reporting they were seeing drones in the sky above New Jersey. Those reports have increased to include witnesses in several neighboring states.     

Local Republican state Sen. James Tedisco issued a statement on Dec. 14 urging “government leaders at the federal, state and local levels need to take this situation seriously.  It’s inexplicable to me how the FAA and Defense Department can credibly say on the one hand they don’t know the origin of the drones, some of which are flying above or near restricted airspace, and on the other hand claim they’re not a threat. That’s just laughable,” Tedisco said. 

“If the government truly doesn’t know what these drones are, their purpose, or where they are from, then they need to shoot one down and find out,” said Tedisco, echoing the words President-elect Donald Trump posted a day earlier.

Week of December 13 – December 19, 2024

Saratoga County Court

Elizabeth N. Burns, 29. Of Grover, N.Y., was sentenced to 5 years probation, after pleading to attempted criminal sale of a weapon, a felony, charged April 2024 in Saratoga Springs. 

Scott F. Parillo, 51, of Saratoga Springs, was sentenced to 6 months incarceration/ 5 years probation, after pleading to felony DWI, in Saratoga Springs April 2024.

Michael Pelletier, 26, of Hudson Falls, was sentenced to an aggregate term of 22 years incarceration/ 20 years post-release supervision, after a three-week jury trial in Saratoga County. The multiple charges stem from a physical and sexual assault in the town of Moreau in June 2024, according to a statement from Saratoga County District Attorney Karen Heggen. 

“Witness testimony and the physical evidence proved that the defendant violently assaulted a 31-year-old female, physically and sexually inside his home, with children present,” Heggen said. In addition to the incarceration sentence, Pelletier will be required to register as a sex offender and is ordered to have no contact with the victim for 30 years.    

Nicholas J. Lamboy, 54, of Ballston Lake, was sentenced to 120 days incarceration/ 5 years probation, after pleading to menacing in the second-degree, and menacing a police officer – a felony, charged March 2024 in Clifton Park.  

Carly L. Johnson, 41, of Ballston Spa, was sentenced to 5 years of probation, after pleading to felony DWI, charged January 2024 in Clifton Park. 

John F. Fink, 41, of Troy, was sentenced to 1-1/2 to 3 years incarceration, after pleading to criminal contempt in the second-degree, and aggravated family offense – a felony, charged June 2024 in Mechanicville. 

Djontay D. Bennifield, 25, of Greenfield, was sentenced to 2 to 4 years incarceration, after pleading to aggravated family offense, a felony, charged January 2024 in Saratoga Springs. 

Michael D. Belcher, 25, of Middle Grove, was sentenced to 2-1/3 to 7 years incarceration, after pleading to grand larceny in the third-degree, and 1-1/3 to 4 years incarceration after pleading to grand larceny in the fourth-degree, charged in early 2024, and late 2023, respectively. Sentences to run concurrently. 

Konrad D. Odhiambo, 30, of Troy, was sentenced to 120 days/ 5 years probation, after pleading to felony DWI, charged December 2023 in Saratoga Springs.   

John A. Rathbun, 27, was sentenced to 3-1/2 years incarceration/ 5 years post-release supervision, after pleading to felony burglary, charged May 2024 in Halfmoon. 

Siatar K. Creech, 38, of Northumberland, was sentenced to 2 to 6 years incarceration after pleading to use of a child in a sexual performance, and 3-1/2 years incarceration/ 10 years post-release supervision after pleading to rape in the third-degree, charged June and July 2022 in the town of Moreau. Sentences to run consecutively. 

Week of December 6 – December 12, 2024      

Saratoga County Court

Erik J. McIntosh, 34, was sentenced to 14 years incarceration in a state facility, to be followed by 5 years post-release supervision, after pleading to robbery in the first-degree, charged June 2021 in the town of Wilton. 

Michael T. May, 28, of Saratoga Springs, was sentenced to 1-1/3 to 4 years incarceration in a state facility after pleading to promoting an obscene sexual performance by a child – charged in Moreau in December 2022, and 4 years incarceration in a state facility after pleading to rape in the third-degree, charged January 2021 in Malta. Sentences to run consecutively, to be followed by 10 years post-release supervision. 

Corey M. Russell, 37, of Queensbury, was sentenced to 1-1/3 to 3 years incarceration in a state facility after pleading to criminal contempt in the first-degree, charged August 2024 in Moreau.  

Saratoga Springs Police

A 39-year-old Saratoga Springs man is facing multiple drug-related charges following a narcotics arrest. 

The Saratoga Springs Police Department’s Special Investigations Unit, supported by the Patrol Division, executed a search warrant at a residence on East Harrison Street in Saratoga Springs on Nov. 26. Police said the search followed an extensive investigation triggered by numerous complaints from local residents regarding ongoing suspicious activity, including heavy pedestrian and vehicle traffic at all hours of the day and night. 

The search led to the arrest of 39-year-old Michael Rosebrook. It is alleged that Rosebrook was found in possession of Fentanyl and crack cocaine at the time of his arrest. Rosebrook was held pending arraignment in City Court, where the District Attorney’s Office is seeking $75,000 cash bail, $150,000 in partial bond, or $750,000 in full bond. 

The arrest follows an earlier incident on June 6, 2024, when Rosebrook was arrested and charged by the Saratoga Springs Police Department. He is currently awaiting final disposition of that case. 

Charges: Criminal Sale of a Controlled Substance on or near School Grounds (2 counts)- a Class B Felony Criminal Possession of a Controlled Substance in the 3rd Degree (3 counts)- a Class B felony Tampering with Physical Evidence, a Class E Felony Criminal Nuisance 1st Degree, a Class E Felony Criminal Possession of a Controlled Substance 7th Degree- a Class A Misdemeanor. 

Saratoga County Sheriff’s Office

The Sheriff’s Office investigated a domestic incident complaint on Charlton Road in the town of Charlton on Nov. 26. As a result of the investigation, Heather R. Cianfarani, 42, of Charlton was charged with criminal possession of a firearm (class E felony). Cianfarani is accused of possessing a pistol without having a license to do so. She was arraigned before the Honorable Sean Piasecki in the Charlton Town Court and released on her own recognizance pending further proceedings. WRGB reported Cianfarani is a teacher at Wood Road Elementary in Ballston Spa.

Jamel D. Gray, 30, of Ballston Spa, was sentenced to 364 days incarceration, after pleading to felony DWI, charged June 2024 in Saratoga Springs, and 2 to 4 years incarceration after pleading to grand larceny in the fourth-degree, charged February 2024 in Ballston Spa. Sentences to run concurrently. 

George S. Tinoco, 49, of Mechanicville, was sentenced to 2 to 4 years incarceration, after pleading to burglary in the third-degree, charged January 2024 in Malta. 

Betsey M. Jablonski, 40, of Amsterdam, was sentenced to 364 days incarceration after pleading to grand larceny in the fourth-degree, charged October 2023 in Clifton Park. 

Alfred J. Hall, 42, of Gansevoort, was sentenced to 1-1/2 years incarceration, after pleading to attempted criminal sale of a controlled substance in the third-degree, charged November 2022 in Moreau. 

Daniel H. Gudar, 44, of Saratoga Springs, was sentenced to 6 months incarceration/ 5 years probation after pleading to felony criminal mischief, charged December 2023 in Saratoga Springs. 

Justin A. Grabowski, 36, of Fraser, Colorado, was sentenced to 30 days incarceration/ 5 years probation after pleading to felony DWI, charged July 2024 in Saratoga Springs. 

Eugene F. Wachtel, 57, of Schenectady, was sentenced to 1-1/2 to 3 years incarceration, after pleading to grand larceny in the fourth-degree, charged June 2023 in Clifton Park. 

Luke A. Fletcher, 42, of Saratoga Springs, was sentenced to an aggregate term of 2 to 6 years incarceration for 2 counts possessing a sexual performance by a child, charged May 2023 in Saratoga Springs. 

James J. Forgett, 54, of Ballston Lake, was sentenced to 5 years incarceration/ 20 years post-release supervision, after pleading to rape in the first-degree, charged summer 2018 in Clifton Park.

James D. Trudeau, 62, of Cohoes, was sentenced to 5 years probation, after pleading to misdemeanor DWI, and aggravated unlicensed operation of a motor vehicle in the first-degree, charged June 2024 in Halfmoon.  

Tyrone T. Carter, 38, of Troy, was sentenced to 5 years probation, after pleading to burglary in the third-degree, charged October 2023 in Waterford. 

Jayden K. Buckmaster, 20, of Ballston Spa, was sentenced to 15 to 20 years incarceration for rape in the first-degree, and 2-1/3 to 7 years incarceration for promoting a sexual performance by a child, charged October 2022 in Greenfield. Sentences to run concurrently. 

Logan M. Andreadakis, 26, of Queensbury, was sentenced to 10 years of probation, after pleading to rape in the second-degree, charged April 2020 in Greenfield. 

Edward J. Young, 73, of Mechanicville, was sentenced to 1 to 3 years incarceration, after pleading to felony DWI, charged July 2024 in Malta. 

Michael S. Andrews, 28, of Ballston Spa, was sentenced to 5 years incarceration/ 2 years post-release supervision, after pleading to criminal possession of a controlled substance in the third-degree, charged May 2024 in Ballston. 

Week of October 19 – October 25, 2024

Saratoga County Court 

Mikhail Anthony Green, 22, of Albany, was sentenced to 2 years incarceration/ 2 years post-release supervision after pleading to attempted criminal possession of a weapon in the second-degree, charged January 2024 in Halfmoon. 

Thomas J. Darrah, Jr., was sentenced to 2 years incarceration/ 2 years post-release supervision, after pleading to attempted criminal possession of a controlled substance in the third-degree, charged July 2024 in Moreau. 

Brandon M. Tubbs, 35, of Corinth, was sentenced to 2 years incarceration/ 1 year post-release supervision, after pleading to criminal possession of a controlled substance in the second-degree charged March 2024 in Corinth.   

Casey M. Francis, 42, of Troy, was sentenced to 364 days incarceration, after pleading to attempted burglary in the third-degree, charged September 2023 in Wilton. 

Edward M. Carroll, 27, of Clifton Park, was sentenced to 30 hours community service/ 5 years probation, after pleading to felony DWI, charged March 2024. 

New York State Police 

On Oct. 12, at about 9 p.m., State Police of Saratoga responded to the reports of a disturbance in Greenfield.  One of the individuals involved, later identified as Derrick B. Bennett, 40, of Amsterdam, left the location in a vehicle with three passengers under the age of 16 prior to law enforcement’s arrival.  Bennett was stopped in the area of State Route 67 in Charlton, for multiple Vehicle and Traffic Law violations.  The three children were turned over to a family member.  Bennett was arrested for three counts of Aggravated Driving While Intoxicated with a Child (Leandra’s Law), three counts of Endangering the Welfare of a Child, and other Vehicle and Traffic Law violations. He was transported to SP Saratoga for processing, where he refused to provide a sample to determine the alcohol content of his blood. Further investigation discovered Bennett has had a previous DWI conviction in the last ten years.  Bennett was also charged with an additional count of Endangering the Welfare of a Child and Criminal Mischief in the fourth degree as a result of the disturbance investigation in Greenfield, where he allegedly harassed and damaged the property of a child. Bennett was arraigned on the DWI charges at the Charlton Town Court and remanded to the Saratoga County Correctional Facility without bail.

On Oct. 13, State Police of Saratoga responded to the reports of an erratic vehicle on northbound I-87 in Saratoga County. Troopers located the vehicle matching the caller’s description and stopped it for a Vehicle and Traffic Law violation on I-87 in Wilton.   The driver was identified as Daniel A. Kowalczyn, 39, of East Bridgewater, MA. Kowalcyzn was arrested for Driving While intoxicated and other Vehicle and Traffic Law violations.  He was transported to SP Wilton for processing, where he recorded a 0.38% BAC. Kowalczyn was issued tickets returnable to the Wilton Town Court on Nov. 12, and released to a sober third party.    

On Oct. 15, at about 5:10 p.m., State Police assigned to the Northway Interstate Patrol responded to I-87 in Clifton Park, for the reports of a vehicle driving erratically. Troopers located the vehicle, which matched the caller’s description, and stopped it for a Vehicle and Traffic Law violation. The driver was identified as Andrew Peru, 40, of Schenectady. Peru was arrested for Driving While Intoxicated and other Vehicle and Traffic Law violations. He was transported to SP Clifton Park for processing, where he recorded a 0.21% BAC.   Peru was issued tickets returnable to the Clifton Park Town Court on Oct. 30, and released to a sober third party.   

Saratoga Sheriff’s Dep’t: If You See Something, Say Something – To Police 

BALLSTON SPA — The Sheriff’s Office says it is aware of a series of online threats that had been shared among several school districts in the Capital Region recently, and that none of those threats were found to be credible.

“One of the biggest issues we’re dealing with is that of reposting versus reporting,” said Sheriff Michael H. Zurlo, in a statement. “Instead of reporting an online threat to the police, we’re finding that some people are reposting the threat. While perhaps well-intentioned, this increases our workload exponentially, can have us chasing down leads that don’t need to be chased and take us away from the ones that do.” 

The Sheriff’s Office encourages parents and caregivers to discuss with their children the concept of reposting versus reporting. 

Any online threat, or any threat for that matter, should always be reported to the police so that the correct safety measures may be implemented immediately, police said. Reposting a threat online can serve to create confusion and fear and is potentially criminal in nature.

Saratoga County Court

Courtney H. Worrock, 27, of Schenectady, was sentenced to 364 days incarceration, after pleading to grand larceny in the fourth-degree, charged April 2023 in Saratoga Springs. 

Renee Delles, 21, of Troy, was sentenced to time served/ 5 years probation, after pleading to burglary in the third-degree, charged October 2023 in Waterford. 

Marquin A. Blake, 31, of Schenectady, was sentenced to 3 years incarceration/ 5 years post-release supervision, after pleading to attempted criminal possession of a weapon in the second-degree, charged January 2024 in Saratoga Springs. 

Michael Pelletier, of Moreau, was convicted after a three-week long jury trial of criminal sexual act in the first-degree, sexual abuse in the first-degree, assault in the second-degree and assault in the third-degree, and endangering the welfare of a child, according to Saratoga County District Attorney Karen Heggen. The physical and sexual assault stems from an incident June 24, 2023 on Selfridge Road in the town of Moreau. Pelletier “violently assaulted a 32-year-old female, physically and sexually, inside his home with children present,” according to the statement. Pelletier faces up to 25 years in state prison on the criminal sexual act conviction and designation as a sex offender. Sentencing Dec. 4.  

James A. Topper, 28, of Galway, was sentenced to 364 days incarceration, after pleading to felony DWI charged February 2024 in Saratoga Springs, in addition to a second sentence of identical length after pleading to felony DWI charged November 2023 in Malta. Sentences to run concurrently. 

David M. Messmore, 56, of Schenectady, was sentenced to 1-1/2 to 3 years incarceration, after pleading to attempted burglary in the third-degree, a felony, charged June 2023 in Wilton. 

Ronald Nellis, 37, of Moreau, was  sentenced to 5 years incarceration/ 15 years post-release supervision, after pleading to sexual abuse in the first-degree, a felony, charged summer 2023 in Moreau. 

Ryan M. Danaher, 34, of Saratoga, was sentenced to 10 years incarceration/ 5 years post-release supervision, after pleading to two felony counts assault and one misdemeanor count menacing, charged in November and December 2023 in Schuylerville.  

Michael S. West, Jr., 38, of Greenfield, was sentenced to 364 days incarceration, after pleading to possession of a controlled substance in the fifth-degree, charged July 2023 in Saratoga Springs. 

Adam Pipino, 29, was sentenced to 1-1/3 to 4 years incarceration, after pleading to criminal contempt in the fifth-degree, charged July 2024 in Mechanicville. 

Michael S. Suprenant, 36, of Ballston, was sentenced to 2 to 4 years incarceration, after pleading to grand larceny in the fourth-degree, charged January 2024 in Halfmoon.
