Week of June 29 – July 5, 2024

Saratoga County Court 

Daniel H. Gudar, 47, of Saratoga Springs, pleaded to criminal mischief in the third-degree, a felony, charged December 2023 in Saratoga Springs. Sentencing Aug. 13. 

Ashley Vetrano, 35, of Glens Falls, was sentenced to 364 days incarceration, after pleading to robbery in the third-degree, charged March 2023 in Moreau. 

Dean J. Atwell, 35, of Middle Grove, was sentenced to 2 to 4 years incarceration, after pleading to grand larceny in the third-degree, charged Jan. 1, 2024 in Galway. 

Bo J. Effner, 41, of Rotterdam, was sentenced to 5 days incarceration/ 5 years probation, after pleading to felony DWI, charged October 2023 in Clifton Park. 

Alicia L. Marcotte, 35, of Hadley, was sentenced to 5 years probation, after pleading to DWAI, charged July 2023 in Corinth. 

Christopher DiLallo, 40, of Mechanicville, was sentenced to 364 days incarceration, after pleading to criminal contempt in the first-degree, charged March 2023 in Wilton. 

John A. Donaldson, 69, of Lackawanna, N.Y., pleaded to sexual abuse in the first-degree, a felony, charged in Milton. Sentencing Aug. 12. 

Christopher L. Crispell, 42, of Waterford, was sentenced to 2 to 4 years incarceration, after pleading to grand larceny in the fourth-degree, charged July 2023 in Stillwater. 

New York  State Police

New York State Police, with the assistance of the Aiken County Sheriff’s Office (South Carolina) and the United State Marshal Service, took custody of Siatar K Creech, 36.  Creech was arrested by State Police on Sept. 12, 2022, on a warrant for Use of a Child in a Sexual Performance, a class “C” felony, Rape in the Third Degree, a class “E” felony and Criminal Sexual Act in the Third Degree, a class “E” felony.  He was arraigned the same day at the Ballston Spa Village Court, where he was released on his own recognizance. 

Creech failed to appear in court for the necessary proceedings, and on Oct. 11, 2023, the Saratoga County Court issued a bench warrant for his arrest.  The investigation determined Creech had allegedly fled New York and was residing in South Carolina.   In a joint agency effort, Creech was located in North Augusta, SC and on May 28, 2024, the Aiken County Sheriff’s Office took him into custody.

Creech was extradited and returned to New York by New York State Police Investigators on June 11, 2024, and turned over to the custody of the Saratoga County Correctional Facility to await arraignment.

Saratoga County Sheriff’s Office 

The Sheriff’s Office responded to a sexual assault call that reportedly occurred on Lilith Fair in the town of Milton. Investigation into the complaint led to the arrest of Anthony J. Collins, 42, of Ballston Spa. Collins was charged with rape in the 1st degree (class B felony) and assault in the 3rd degree (class A misdemeanor). Collins was arraigned in the Milton Town Court and sent to the Saratoga County Jail without bail pending further action in the matter.

The Sheriff’s Office arrested Damian B. Ball, 27, of Corinth on an arrest warrant issued by the Wilton Town Court for burglary in the 3rd degree (class D felony) and petit larceny (class A misdemeanor. Ball is accused of stealing from Walmart in the town of Wilton on Sept. 28, 2023 after previously being banned from the business’ property. He was arraigned in the Wilton Town Court and released on his own recognizance pending further action in the matter.

Week of June 22 – June 28

Saratoga County Sheriff’s Office

The Sheriff’s Office responded to a disturbance call on Main Street in the village of Corinth. Investigation into the matter resulted in the arrest of William J. Arnold, 25, of Corinth, charged with criminal mischief in the 3rd degree (class E felony). Arnold is accused of intentionally damaging a television and a PlayStation belonging to another person in an amount exceeding $250. He was arraigned in the Corinth Town Court and released to pretrial services pending further action in the matter.

Philip J. McCulloch, 36, of Halfmoon, and Tashawna S.D. Daniel, 38, of Cohoes, were each charged with criminal possession of stolen property in the 4th degree (class E felony), in connection with a vehicle that had been reported stolen out of the city of Troy. McCulloch was additionally charged with aggravated unlicensed operation of a motor vehicle in the 3rd degree. Both persons were released on appearance tickets returnable to the Halfmoon Town Court on a later date.

Aaron B. Mondore, 48, was charged with criminal mischief in the 3rd degree (class E felony) and criminal mischief in the 4th degree (class A misdemeanor). Mondore is accused of intentionally damaging property belonging to another person in an amount exceeding $250 and of intentionally preventing that person from communicating a request for emergency assistance by physically taking their cellular telephone from them and throwing it into a pool. He was released on an appearance ticket returnable to the Wilton Town Court on a later date.

Joshua D. Temple, 32, of Cohoes, was charged with bail jumping in the 2nd degree (class E felony). Temple is accused of failing to appear in court as directed for original charges of grand larceny in the 4th degree and a previous bail jumping in the 2nd degree charge from the same matter. He sent to the Saratoga County Jail in lieu of bail pending further action in the matter in the Halfmoon Town Court.

Tyler J. Marley, 31, of Schenectady, was arrested on an arrest warrant for burglary in the 3rd degree (class D felony).  Marley is accused of stealing from the Home Depot in the town of Halfmoon on March 20, 2024, after having previously been noticed that he was forbidden to be in the store. He was released to pretrial services pending further action in the matter.

Jacqueline Shafer, 47, of Schenectady, was arrested on a warrant for grand larceny in the 2nd degree (class C felony) and forgery in the 2nd degree (class D felony). Shafer is accused of stealing money in excess of $50,000 while employed at an apartment complex in the town of Malta between August 2021 and April 2022. She is also charged with falsely making, completing or altering a written instrument with the intent to defraud, deceive or injure another. She was released to pretrial services pending further action in the matter.

Kenneth J. Rossen, 61, of Malta, was charged with possession of a forged instrument in the 2nd degree (class D felony), operating a motor vehicle with a suspended or revoked registration, aggravated unlicensed operation of a motor vehicle in the 2nd degree (unclassified misdemeanors), improper plates, and improper or no signal (infractions). Rossen is accused of having a forged temporary license plate on his vehicle, of operating a motor vehicle with a suspended registration, and of operating a motor vehicle while his license to do so was suspended three or more times on three separate dates for failure to answer a summons, appear, or pay a fine. He was issued appearance tickets returnable to the Clifton Park Town Court on a later date.

John B. Fleeman, 26, of Fort Edward, was arrested on a warrant issued from Saratoga Town Court for criminal contempt in the 1st degree (class E felony). Fleeman is accused of violating an order of protection by following the protected party and engaging in a verbal argument with them. The charge was upgraded to a felony due to a previous conviction for criminal contempt in the 2nd degree within the preceding 5 years. He was arraigned in the Galway Town Court and sent to the Saratoga County Jail without bail pending further action in the matter.

June 15 – June 21, 2024

Saratoga County Sheriff’s Office 

A 20-year-old Watervliet man was charged with first degree manslaughter after allegedly “striking another person with a large wrench and causing that person’s death,” according to the Saratoga County Sheriff’s Office.

The sheriff’s office said they received a call of a fight in progress on Sparrow Drive in the town of Malta and the Investigation into the complaint led to the arrest of Cyrus J. Tetreault, 20, of Watervliet. 

The victim was identified as 53-year-old Malta resident Brian M. Miller. 

“It is truly tragic that this situation resulted in a loss of life,” county Sheriff Michael Zurlo said in a statement. “I am grateful for the professional response of the men and women of my agency and for the quick identification and arrest of the person responsible.” 

The Sheriff’s Office arrested Jacques S. Boisvert, 45, and Jacques A. Boisvert, IV, 20, of Malta on arrest warrants for criminal possession of stolen property in the 3rd degree (class D felony). The charges stem from an allegation that they possessed a stolen trailer that had a value in excess of $3,000. The original call was received by the Sheriff’s Office on April 23, 2024, and occurred on Hubbs Road in the town of Malta. The elder Boisvert was released to pretrial services while the younger was released on his own recognizance pending further action in the matter.

The Sheriff’s Office responded to a disturbance call on Sacandaga Road in the town of Galway. As a result of the investigation into the matter, Gerrod M. Jones, 40, of Galway, was charged with strangulation in the 2nd degree (class D felony). Jones is accused of placing another person in a chokehold resulting in loss of consciousness. He was arraigned in the Galway Town Court and released to pretrial services pending further action in the matter.

The Sheriff’s Office responded to a call of an inactive larceny at the Northway Golf Center on Crescent Road in the town of Halfmoon. Investigation into the complaint led to the arrest of Clayton J. Callan (age 37) Malta, charged with falsifying business records in the 1st degree and grand larceny in the 4th degree (class E felonies). Callan is accused of stealing from the store in an amount exceeding $1,000. Additionally, he is charged with falsifying the store’s business records with the intent to defraud and to commit another crime. He was arraigned in the Halfmoon Town Court and released on his own recognizance pending further action in the matter.

The Sheriff’s Office received a call of an inactive burglary at Fuller’s Corner Store in the town of Edinburg. Investigation into the complaint led to the arrest of Kerrilyn S. Polite, 41, of Northville, charged with burglary in the 3rd degree (class D felony). Polite is accused of entering and remaining unlawfully in a building with intent to commit a crime therein. She was arraigned in the Edinburg Town Court and remanded to the Saratoga County Jail pending further action in the matter. 

Saratoga County Court

Justin Franz, 39, of Cohoes, pleaded to robbery in the second-degree, charged July 2023 in Mechanicville. Sentencing Aug. 2. 

Alia M. Sullivan, 39, of Hadley, pleaded to felony DWI, charged July 2023. Sentencing Junly 29. 

Lovell T. Roper, 31, of Manhattan, was sentenced to 2-1/2 years incarceration/ 1 year post-release supervision, after pleading to felony criminal possession of a controlled substance, charged September 2020 in Moreau. 

Raymond K. Sedlak, 67, of Waterford, pleaded to DWI, and Aggravated unlicensed operation of a motor vehicle, charged Jan. 1, 2024. Sentencing Aug. 1. 

Leona McLean, 32, of Albany, was sentenced to 5 years probation, after pleading to criminal possession of stolen property in the fourth-degree, charged February 2023 in Malta. 

June 8 – 14, 2024

Saratoga County Court

Matthew J. Gifford, 31, of Saratoga Springs, was sentenced to 5 days incarceration and 5 years probation, after pleading to felony DWI, charged February 2024 in Saratoga Springs. 

Kevin P. Masterson, 52, of Mechanicville, was sentenced to 6-1/2 years incarceration / 5 years post-release supervision, after pleading to criminal possession of a weapon in the second-degree, charged May 2023. 

Shawn Flores, 45, of Milton, pleaded to criminal contempt in the first-degree, charged February 2024. Sentencing July 30. 

Nicholas F. Bonfante, 44, of Halfmoon, pleaded to criminal sale of a controlled substance in the second-degree, a felony, charged March 2022. Sentencing July 10. 

Sherman J. Chambers, 50, of Albany, was sentenced to 3 to 6 years incarceration, after pleading to criminal mischief in the second-degree, a felony. During the early morning hours of Aug. 20, 2023, Chambers entered the parking lot of Saratoga Honda “and proceeded to forcibly remove the tires from a parked vehicle as well as steal a variety of personal items from several other vehicles,” according to statement released by Saratoga County District Attorney Karen Heggen on May 28. Chambers pleaded guilty and was sentenced as a second felony offender to 3 to 6 years incarceration, as well as being ordered to pay full restitution to Saratoga Honda, Heggen added.   

Janelle F. Eberts, 60, of Schuylerville, pleaded to felony DWAI, charged October 2023 in Saratoga Springs. Sentencing July 31. 

Saratoga County Sheriff’s Office 

The Sheriff’s Office arrested James L. Shaw, III, 34, of Mechanicville on a warrant issued by the Halfmoon Town Court for criminal mischief in the 3rd degree (class E felony) and criminal trespass in the 2nd degree (class A misdemeanor). The original incident allegedly occurred on June 22, 2020, on Hudson River Road in the town of Halfmoon:, Shaw is accused of intentionally damaging a kitchen door belonging to another person in an amount exceeding $250 and of entering or remaining unlawfully in a dwelling. He was released pending an appearance in the Halfmoon Town Court on a later date.

The Sheriff’s Office responded to a call of an unresponsive male in a vehicle stopped in the lane of travel in the area of Legends Way in the town of Clifton Park. Investigation into the matter led to the arrest of Benjamin T. VanDusen, 31, of Clifton Park, charged with DWI (class E felony), failure to keep right, and parking on the highway (infractions). VanDusen is accused of operating a motor vehicle while in an intoxicated condition. The charge was upgraded to a felony due to a previous conviction within the preceding 10 years. He was arraigned in the Halfmoon Town Court and released on his own recognizance pending further action in the matter.

The Sheriff’s Office conducted a vehicle stop for speeding on Union Avenue in Saratoga Springs. As a result of the stop and further investigation, Alexa C. Dalberto, 35, of Stillwater, was charged with DWI (class E felony), and speeding (infraction). The charge was upgraded to a felony due to a previous conviction within the preceding 10 years. She was released on an appearance ticket pending further action in the matter.

New York State Police

State Police of SP Saratoga, with the assistance of the Troop G Computer Crimes Unit and the Internet Crimes Against Children Taskforce, arrested Jordan D. Pregent, 24, of Saratoga Springs, for Possessing a Sexual Performance by a Child, a class “E” felony. Pregent is accused of knowingly possessing digital media of a performance of sexual conduct by a child less than 16 years of age.  Pregent’s arrest followed an investigation stemming from a cyber tip received through the National Center for Missing and Exploited Children. Pregent was arrested and processed at SP Saratoga.

June 1 – 7, 2024

Saratoga County Court

Kaitlyn Walker, 23, of Corinth, pleaded to assault in the second-degree, charged November-December 2023. Sentencing May 14, 2025. 

Zachary Michaels, 29, of Saratoga Springs, was sentenced to 1-1/2 to 3 years incarceration, after pleading to criminal contempt in the first-degree, charged December 2023 in Saratoga Springs. 

Catherine A. Christopher, 47, of Ballston Spa, was sentenced to 90 days incarceration at the Saratoga County Correctional Facility (time served), to be followed by 5 years of probation, after pleading to assault in the second-degree, charged in January in Malta. 

Denis Salinas Alvarez, 29, of Mechanicville, was sentenced to 5 days incarceration and 5 years probation, after pleading to felony DWI, charged August 2023. 

Jonathan E. Joyal, 31, of Ballston, was sentenced to 5 years probation, after pleading to felony DWI, charged June 2023. 

Anthony P. Delaurie, Jr., was sentenced to 4-1/2 years incarceration and 5 years probation, after pleading to attempted criminal possession of a controlled substance in the second-degree, charged April 2023 in Malta. 

Dylan Benaquista, 28, of Halfmoon, was sentenced to 364 days incarceration, after pleading to felony burglary, charged June 2023. 

Tiffany M. Salak, 35, of Saratoga Springs, was sentenced to 2 years incarceration and 1 year post-release supervision, after pleading to criminal possession of a controlled substance in the fifth-degree, charged July 2023. 

Royal D. Hamilton, 43, of Corinth, pleaded to felony DWI, charged August 2023 in Saratoga Springs. Sentencing Aug. 29. 

Kevin Decelle, 34, of Malta, pleaded to felony strangulation and felony burglary, charged November 2023 in Halfmoon. Sentencing Aug. 2. 

Christopher Barnes, 44, of Wilton, pleaded to criminal contempt in the first-degree, charged March 2024. Sentencing July 26. 

Lee Horning, Jr., 37, of Gloversville, pleaded to rape in the second-degree, charged September 2023 in Edinburg. Sentencing July 30. 

Janelle Peer-Mohan, 37, of Milton, was sentenced to 5 years probation after pleading to criminal possession of property in the fourth-degree, charged January 2023. 

Jeffrey T. Hampshire, 43, of Stillwater, pleaded to aggravated unlicensed operation of a motor vehicle in the first-degree, a felony, charged November 2023. Sentencing Sept. 9. 

John A. Speigel, Jr., 33, of Wappingers Falls, was sentenced to 1 to 3 years incarceration, after pleading to felony DWI, charged February 2024 in Wilton. 

Ryan T. Matatall, 40, of Gansevoort, was sentenced to 5 years probation after pleading to felony DWAI, charged October 2023 in Clifton Park. 

Saratoga County Sheriff’s Office

The Sheriff’s Office responded to a property damage motor vehicle crash on Plant Road in the town of Halfmoon. Investigation into the collision resulted in the arrest of Michael P. Martiniano, 44, of Clifton Park. He was charged with DWI, operating a motor vehicle with a BAC of .08% or greater (class E felonies), AUO in the 3rd degree (unclassified misdemeanor), and failure to yield right of way (infraction).  The charges were upgraded to class E felonies due to a prior DWI conviction. It is alleged that his license was suspended at the time of the crash and that he failed to yield right of way while making a left turn. He was processed and released on appearance tickets returnable to the Halfmoon Town Court on a later date.

The Sheriff’s Office arrested Tyquan T. Simon, 31, of Troy on a warrant for criminal mischief in the 3rd degree (class E felony) from the Charlton Town Court. Simon is accused of intentionally causing damage to a Saratoga County Sheriff’s Office patrol vehicle in an amount exceeding $250 by kicking and punching the rear passenger window and the divider while he was in custody for a separate matter on April 10, 2024. He was arraigned in the Charlton Town Court and remanded to the Saratoga County Jail where he was being held on separate charges pending further action in the matter.

The Sheriff’s Office received a damage/vandalism complaint on Parkis Mills Road in the town of Galway. As a result of the investigation into the complaint, Jerry M. Pepper, 51, of Amsterdam, was arrested and charged with criminal mischief in the 3rd degree (class E felony). Pepper is accused of intentionally damaging a door belonging to another person in an amount exceeding $250. He was processed and released on an appearance ticket returnable to the Galway Town Court on a later date.

May 25 – 31, 2024

Michael J. Arnold, 64, of Schuylerville, pleaded to criminal contempt in the first-degree, charged June and July 2023 in the town of Saratoga. Sentencing Aug. 6. 

Gary A. Lucas, 38, of Schenectady, was sentenced to 1-1/3 to 4 years’ incarceration in a state correctional facility, after pleading to leaving the scene of an incident without reporting death, charged November 2023 in Ballston. 

Matthew J. Hayes, Sr., was sentenced to 1-1/2 years’ incarceration in a state correctional facility and 1 year post-release supervision, after pleading to attempted criminal sale of a controlled substance in the third-degree, charged December 2022 in Corinth.

Margo A. Mead, 36, of West Sand Lake, was sentenced to 364 days in the Saratoga County Correctional Facility, after pleading to criminal possession of stolen property in the fourth degree, charged September 2023 in Malta. 

Meagan E. McGuire, was sentenced to 5 years of probation, after pleading to felony DWI, charged September 2023 in Saratoga Springs. 

Cristina M. Cassidy, 31, of Albany, was sentenced to 364 days in the Saratoga County Correctional Facility, after pleading to grand larceny in the fourth degree, charged October 2022 in Clifton Park. 

John D. Chaname, 43, of East Elmhurst, N.Y., was sentenced to 364 days in the Saratoga County Correctional Facility, after pleading to aggravated unlicensed operation of a motor vehicle, charged November 2023 in Clifton Park. 

Xavier O. Williams, 21, of Watervliet, pleaded to attempted assault in the second-degree, charged October 2023 in Halfmoon. Sentencing July 22. 

Gloria Rhodes, 51, of Saratoga Springs, was sentenced to 5 years of probation and 60 days community service, after pleading to attempted assault in the second-degree, charged May 2023 in Saratoga Springs. 

Thomas J. Lucey, 39, of Troy, was sentenced to 5 years of probation, after pleading to felony DWI, charged March 2023 in Waterford. 

Edward T. Sears, 20, of Schenectady, pleaded to attempted burglary in the third-degree, charged January 2023 in Moreau. Sentencing July 22. 

Kevin S. Cuva, 51, pleaded to criminal contempt in the first-degree, charged February 2024 in Saratoga Springs. Sentencing July 23. 

James M. McFarland, 55, was sentenced to 1 to 3 years in a state correctional facility, after pleading to felony DWI, charged February 2023 in Clifton Park. 

Saratoga County Sheriff’s Office

Haley A. Czwakiel, 27, of Ballston Spa, was charged with aggravated DWI (class E felony), DWI, and operating a motor vehicle with a BAC of .08% or greater (unclassified misdemeanors), following a suspected crash on Saratoga Road in the town of Ballston earlier this month. She was released on appearance tickets returnable to the Ballston Town Court on a later date, according to the Saratoga County Sheriff’s Office.

Ryan A. Madigan, 36, of Burnt Hills, was charged with Assault in the third degree (Misdemeanor), and Aggravated Criminal Contempt (Felony). It is alleged Madigan struck a female known to him in the face causing physical injury. The alleged assault was committed against a party who had an order of protection against Madigan, resulting in the charge of Aggravated Criminal Contempt. He was arraigned by Malta Town Judge Sloat and remanded with bail of $5,000 cash, $10,000 bond or $50,000 partially secured bond. He is scheduled to appear in Ballston Town Court at a later date.

John A. Rathbun, 26, of Verona, was charged with burglary in the second-degree (felony), two counts of criminal mischief in the fourth-degree, petit larceny, resisting arrest, and menacing in the second-degree (misdemeanors). Rathbun is accused of unlawfully entering and remaining in a dwelling in Halfmoon with the intent to commit a crime therein. He was reportedly found hiding in a closet in the residence by the homeowner when she arrived home at which time he allegedly threatened her with a liquor bottle. He is further accused of preventing the homeowner from calling 911 by slapping the phone from her hand and of stealing liquor from the residence. There was no prior relationship between Rathbun and the homeowner. He was arraigned in the Halfmoon Town Court and remanded to the Saratoga County Jail in lieu of bail, bond, or partially secured bond pending further action in the matter.

May 18 – May 24, 2024

The Sheriff’s Office responded to a home on Brookwood Road in the Town of Halfmoon to assist the town Code Enforcement Department. It was found that a large number of canines were living in deplorable conditions at that location. Derrick J. Sud-Nieves, 29, of Halfmoon, was subsequently arrested and charged with 35 counts of NYS Agriculture and Markets Law, section 353 – Overdriving, torturing and injuring animals; failure to provide proper sustenance. Sud-Nieves was processed at the Halfmoon station and released with an appearance ticket. He is scheduled to appear in Halfmoon Town Court at a later date. The Sheriff’s Office was assisted in the investigation by the Town of Halfmoon Code Enforcement, Clifton Park Animal Control and the Humane Society. The animals were seized from the residence and are currently in the care of the Humane Society. The investigation is ongoing, and additional charges may follow.

Following an investigation into an incident that reportedly occurred in 2020 in the town of Greenfield, Logan M. Andreadakis, 25, of Queensbury, was arrested and charged with rape in the 2nd degree (class D felony) and sexual abuse in the 3rd degree (class B misdemeanor). Andreadakis is accused of engaging in sexual intercourse with a then 14-year-old female who was known to him. He was arraigned before Michael Ginley in the Greenfield Town Court and released to pretrial services pending further action in the matter.

Saratoga County Court

Todd A. Axton, 61, of Ballston, was sentenced to 8 months incarceration in the Saratoga County Correctional Facility, after pleading to aggravated criminal contempt, a felony, charged October 2022.

Lewis Labshere, 34, of Schenectady, was sentenced to 1-1/2 to 3 years’ incarceration in a state correctional facility after pleading to criminal contempt in the first-degree, charged February 2024 in Galway.

Jay A, Sherman, 35, of South Glens Falls, was sentenced to time served and 5 years of probation, after pleading to felony DWI, charged August 2023 in Moreau.

Hasan A. Stubbs, 26, of Ballston Spa, pleaded to grand larceny in the fourth degree, a felony, charged in Halfmoon. Sentencing July 11.

Justin W. Cummings, 37, of Porter Corners, was sentenced to 2 years’ incarceration in a state correctional facility, followed by 2 years’ post-release supervision, after pleading to criminal sale of a controlled substance in the third-degree, charged April 2023 in Ballston Spa.

Joseph D. Freshwater, 30, of Saratoga Springs, was sentenced to 3 years’ incarceration in a state correctional facility and 10 years’ post-release supervision, after pleading to sexual abuse in the first-degree, charged August 2023 in Saratoga Springs.

John J. Dominy, 53, of Albany, was sentenced to 1-1/2 to 3 years’ incarceration in a state correctional facility, after pleading to grand larceny in the fourth-degree, charged June 2023 in Wilton.

Leon Carney, 20, of Lake George, pleaded to disseminating indecent material to minors in the first-degree, charged in Saratoga March 2023. Sentencing July 10.

New York State Police

State Police of Clifton Park arrested and charged Jacob R. Hayner, 37, of Mechanicville, with Criminal Mischief in the second degree, Grand Larceny in the fourth degree, Petit Larceny, Reckless Endangerment in the second degree, Reckless Endangerment of Property, Unlawfully Fleeing a Police Officer in a Motor Vehicle in the third degree, and Numerous Vehicle and Traffic Law violations, after Troopers responded to the Stewarts Shop on State Route 146 in Clifton Park, for reports of a stolen vehicle. The investigation revealed Hayner had allegedly stolen the vehicle from the parking lot while the owner was inside the store. Troopers located the vehicle traveling northbound on I-87 in Clifton Park. With the assistance of the Saratoga County Sheriff’s Office, a traffic stop was attempted. The stolen vehicle, still being operated by Hayner failed to comply, and a pursuit was initiated. Hayner began driving recklessly, causing damage to a Saratoga County marked patrol vehicle before a controlled stop was made, and he was taken into custody.

After being processed, Hayner was transported to SP Clifton Park for additional processing, then arraigned at the Halfmoon Town Court, which remanded him to the Saratoga County Correctional Facility in lieu of $5,000 cash, a $10,000 bond, or a $50,000 partially secured bond.

Saratoga County Court

Rick C. Sweet, 36, of Ballston Spa, pleaded to attempted assault in the second-degree, and menacing in the third-degree, charged in January. Sentencing July 3. 

Seth A. Labarbera, 24, of Ballston Lake, was sentenced to 1 year in local jail, after pleading to criminal possession of a weapon in the second-degree, charged July 2023 in Saratoga Springs. 

David A. Fink, 27, of Ballston, was sentenced to 4 years’ incarceration and 5 years’ post-release supervision, after pleading to attempted arson in the second-degree, charged August 2023. 

Michael J. Scensny, 34, of Waterford, was sentenced to 3 years in state prison and 1-1/2 years’ post-release supervision, after pleading to attempted criminal sale of a controlled substance in the second-degree, charged June 2023 in Saratoga Springs. 

Anna E. Carberry, 50, of Mechanicville, was sentenced to 1 to 3 years’ incarceration after pleading to felony DWI charged September 2023 in Waterford, and 1 to 3 years’ incarceration after pleading to felony DWI charged April 2023 in Malta. Sentences to run concurrently. 

Faheem Johnson, 37, of Troy, was sentenced to 5 years’ probation, after pleading to felony DWI, charged March 2023 in Waterford. 

Rafael Brito, 28, of Clifton Park, was sentenced to 2 to 6 years in state prison, after pleading to failure to register or verify as a sex offender, charged November 2021.   

Noah Hughes, 34, of Schenectady, was sentenced to 1-1/2 to 3 years’ incarceration in a state correction facility, after pleading to criminal possession of stolen property in the third-degree, charged February 2023 in Malta. 

Saratoga Springs Police

Members of the Saratoga Springs Police Department Special Investigations Unit earlier this month executed a search warrant of a residence in Vanderbilt Terrace that had been the subject of numerous complaints regarding possible illegal narcotics activity. After obtaining probable cause, a search warrant was applied for through the City Court of Saratoga Springs and executed. Arrested after the search warrant was completed was Michael Dzieniszewski, a 37-year-old man with no address provided to the police, on the below listed charges. Dzieniszewski was processed and arraigned in City Court and remanded to the custody of the Saratoga County Sheriff pending his next court appearance. 

Charges: Criminal Possession of a Controlled Substance in the 3rd Degree, a Class B Felony- Intent to sell Criminal Possession of a Narcotic Drug in the 4th Degree, a Class C Felony Criminal Possession of a Controlled Substance 7th Degree- a Class A Misdemeanor.

Saratoga County Sheriff’s Office 

The Sheriff’s Office responded to a stolen vehicle complaint on I-87 northbound near Exit 10 in Clifton Park. The vehicle had been reported stolen earlier from the parking lot of the Stewart’s shop at 1206 Route 146 and had been located on I-87. As a result of attempting to stop the vehicle, Jacob R. Hayner, age 37, homeless, was arrested and charged with reckless endangerment in the 1st degree; criminal mischief in the 2nd degree (class D felonies); unlawful fleeing a police officer in a motor vehicle in the 3rd degree (class A misdemeanor); and moving from lane unsafely (infraction). Hayner is accused of unlawfully fleeing a marked Sheriff’s patrol vehicle knowing that he had been directed to stop, and of intentionally striking that Sheriff’s patrol unit with his vehicle causing damage in an amount exceeding $1,500. As a result, he is charged with recklessly engaging in conduct that created a grave risk of death to another person under circumstances that evinced a depraved indifference to human life. He was arraigned before the Honorable Robert A. Rybak in the Clifton Park Town Court and remanded to the Saratoga County Jail in lieu of bail, bond, or partially secured bond pending further action in the matter.

The Sheriff’s Office arrested Matthew H. Smith, 58, of Latham on a warrant for aggravated family offense (class E felony) and criminal contempt in the 2nd degree (class A misdemeanor). Smith is accused of intentionally violating an order of protection by repeatedly telephoning the person for whose protection the order was issued while an inmate at the Saratoga County Jail. The felony charge is a result of a previous conviction for a specified offense within the immediately preceding five years. He was arraigned and released to pretrial services pending further action in the matter.

Gregory Adams, 47, of Malta, pleaded to grand larceny in the fourth-degree charged October 2023. Sentencing June 28. 

Anthony J. Torres, 25, of Waterford, pleaded to aggravated unlicensed operation of a motor vehicle in the first-degree, charged April 2023 in Greenfield, and robbery in the third-degree, charged in Waterford January 2024. Sentencing June 28.

Travis L. Smith, 23, of Greenfield Center, pleaded to attempted criminal sale of a controlled substance in the third degree, charged January 2023. Sentencing June 28. 

Jammel A. Dillon, 33, of Saratoga Springs, was sentenced to 2-1/2 to 5 years after pleading to felony robbery, and 1 year after pleading to misdemeanor assault, charged 2023 in Mechanicville. Sentences to run concurrently. 

John A. Speigel, Jr., 33, of Wappingers Falls, pleaded to felony DWI, charged February 2024 in Wilton. Sentencing May 21. 

Clint J. Clark, 51, of Cohoes, pleaded to felony DWI charged December 2023 in Waterford. Sentencing July 11. 

Dominic Bradfute, 26, of South Glens Falls, was sentenced to 5 years’ probation, after pleading to unlawful surveillance in the second-degree, a felony, charged June 2023 in Moreau. 

Brandon Bakerian, 41, of Whitehall, pleaded to criminal contempt in the first-degree, charged November 2023 in Wilton. Sentencing Aug. 5. 

Mark P. Ottati, 34, of Schenectady, pleaded to felony DWI, charged December 2023 in Clifton Park. Sentencing June 25. 

Shahid Smith, 43, was sentenced to an aggregate term of 31-1/2 years in a state correctional facility followed by a post-release supervision of 3 years, Saratoga County District Attorney Karen Heggen announced April 30. 

The sentences were imposed after a trial jury found Smith guilty of four counts criminal sale, and four counts criminal possession of a controlled substance in the third-degree, and one count each criminal sale and criminal possession in the fifth-degree, Heggen reported. The evidence at trial indicated that Smith sold fentanyl, cocaine and crystal methamphetamine on four different occasions in Saratoga County during December 2022, Heggen added. 

To date, there have been 277 overdoses – 17 of them fatal this year in Saratoga County. In 2023, there were 727 overdoses with 39 fatalities countywide. 

Saratoga County Sheriff’s Office

Members of the Saratoga County Sheriff’s Office’s Narcotics Unit and Special Operations Team executed a search warrant at 11 Liberty St. in the village of Corinth following a lengthy investigation into drug trafficking in Saratoga County. As a result of the investigation and warrant service, Nicholas E. Harwood (age 35) of Corinth was arrested and charged with two counts of criminal possession of a controlled substance in the third-degree: one count of criminal possession of a controlled substance in the fifth-degree, and two counts of criminal possession of a controlled substance in the seventh-degree.

Harwood is accused of possessing and selling quantities of crack cocaine and cocaine throughout Saratoga County. He was arraigned before the Honorable Ellwood A. Sloat, Jr., in the Malta Town Court and sent to the Saratoga County Jail in lieu of bail, bond, or partially secured bond, pending further action in the matter.

NY State Police

State Police of Clifton Park received a complaint of an erratic vehicle in the area of Clifton Country Road in Clifton Park. Troopers located a vehicle matching the caller’s description and stopped it on State Route 146 with the assistance of the Saratoga County Sheriff’s Office. The driver was identified as Steven P. Foster, 61, of Clifton Park. Foster was arrested for Driving While intoxicated and other Vehicle and Traffic violations. He was transported to SP Clifton Park for processing, where he recorded a 0.21% BAC. Foster was issued tickets returnable to the Clifton Park Town Court and released.

State Police of Saratoga arrested Frank W. Grasso, 21, of Waterford, for Criminal Possession of Cannabis in the first degree, a class “D” felony, and other Vehicle and Traffic Law violations. Troopers stopped a vehicle on State Route 9 in Saratoga Springs for Vehicle and Traffic Law violations. The driver was identified as Grasso. Further investigation discovered more than 20 pounds of cannabis in Grasso’s vehicle. Grasso was arrested and transported to SP Saratoga for processing. He was arraigned at the Malta Town Court and released on his own recognizance. 

April 27 – May 3, 2024

Saratoga County Sheriff’s Office 

-The Sheriff’s Office received a call of a domestic incident on April 20, that reportedly occurred on N.Y.S. Route 29 in the town of Galway. Investigation into the matter led to the arrest of Jose C. Sartin (age 30) of Middle Grove, who was charged with robbery in the 3rd degree (class D felony), and assault in the 3rd degree (class A misdemeanor). Sartin is accused of striking another person to the facial area resulting in physical injury and of forcibly stealing property from that person. He was arraigned before the Honorable Timothy M. Brown in the Milton Town Court and released on his own recognizance pending further action in the matter.

-The Sheriff’s Office responded to a disturbance call on Howe Road in the town of Corinth on March 30. Investigation into the matter led to the arrest on April 20 of Samuel E. Paquin (age 60) of Greenfield, who was charged with criminal mischief in the 2nd degree (class D felony) and reckless endangerment in the 2nd degree (class A misdemeanor). Paquin is accused of intentionally ramming another person’s vehicle with his own resulting in damage in an amount that exceeded $1,500. He is also accused of recklessly engaging in conduct that created a substantial risk of serious physical injury to another person. He was ordered to be released on an appearance ticket by the Honorable Michael T. Woodcock of the Corinth Town Court pending further action in the matter.

On Feb. 20, the Sheriff’s Office responded to a stabbing call involving a 16-year-old victim on Redfield Park in the town of Clifton Park. Investigation into the incident identified two adolescent male offenders and an adult male as having participated in the stabbing. 

The two were each charged with assault in the 1st degree and gang assault in the 1st degree (class B felonies). Both were arraigned and released to the custody of their guardians pending further action in the matter. 

The adult male, Coray A. Marrero (age 19) of Queens, NY, was charged with the same offenses as the juveniles as well as robbery in the 2nd degree (class C felony). Marrero was arrested in Queens by the NYPD on separate charges and turned over to the Sheriff’s Office on April 19. He was arraigned before the Honorable Timothy M. Brown and remanded to the Saratoga County Jail in lieu of bail, bond, or partially secured bond pending further action in the matter.

The victim was transported to Albany Medical Center where he underwent emergency surgery for potentially life-threatening injuries.

During the course of the investigation into the stabbing, it was discovered that the incident was in retaliation for a robbery that had occurred at the Walmart in the town of Halfmoon on Feb. 13. It is alleged that during this incident, a juvenile male was forced into a vehicle and robbed at gunpoint.

As a result of this investigation, Tyler J. Reed (age 20) of Schenectady, one adolescent male offender, and one juvenile male offender were charged with robbery in the 1st degree and kidnapping in the 2nd degree (class B felonies). One of the charged persons was the stabbing victim in the Clifton Park incident.

Reed was arraigned before the Honorable Katherine Suchocki in the Halfmoon Town Court on Feb. 28, and remanded to the Saratoga County Jail in lieu of bail, insured bond, or partially secured bond to await further action in the matter. The adolescent male offender was arraigned and remanded to a secure detention facility in lieu of bail pending further proceedings in the matter, and the juvenile male offender was arraigned and released to a guardian pending further proceedings in the matter.
