COURT 

Aaron J. Buckner, 44, of Ballston Spa, pleaded Feb. 19 to attempted criminal sale of a controlled substance, a felony.  Sentencing May 7. 

Brittney A. Jaworski, 34, of Schuylerville, was sentenced Feb. 19 to time served and five years of probation, after pleading to criminal sale of a controlled substance, a felony.    

Carlos Ventura, 22, of Saratoga Springs, was sentenced Feb. 19 to 8 years in state prison, and 3 years of post-release supervision, after pleading to criminal possession of a controlled substance, a felony. 

Michael S. Sanders, 51, of Ballston Spa, was sentenced Feb. 19 to 1-1/2 to 3 years in state prison, after pleading to criminal contempt, a felony.

Loreal Bass, 39, of Schenectady, was charged Feb. 12 in Saratoga Springs with felony grand larceny.

George Degaspard, 66, of Saratoga Springs, was charged Feb. 14 with felony grand larceny. 

Susan Degaspard, 66, of Saratoga Springs, was charged Feb. 14 with felony grand larceny, and issuing a bad check with knowledge of insufficient funds. 

Miriam Sanders, 50, of Saratoga Springs, was charged Feb. 15 with misdemeanor petit larceny. 

Timothy Smith, 58, of Saratoga Springs, was charged Feb. 15 with two misdemeanor counts of criminal trespass. 

Clarissa Rock, 30, of Gansevoort, was charged Feb. 16 in Saratoga Springs with misdemeanor DWI, misdemeanor aggravated DWI, and aggravated unlicensed operation of a motor vehicle.

Adam Ross, 38, of Greenfield Center, was charged Feb. 16 in Saratoga Springs with felony DWI as having a previous DWI conviction within 10 years, using a vehicle not equipped with an interlock device, aggravated unlicensed operation of a motor vehicle, refusing to take a breath test, and speeding. 

Xenthippi M. Bernard, 57, of Ballston Spa, was charged Feb. 19 in the town of Milton with DWI, aggravated DWI, obstructing governmental administration, and assault on a police officer. 

James V. Primarolo, age 30, of Saratoga Springs, was charged Feb. 20 with reckless endangerment in the first-degree, criminal possession of an assault weapon in the third-degree – both felonies, as well as the misdemeanors criminal possession of a controlled substance, criminal possession of a weapon, and criminal mischief. Primarolo is alleged to have discharged a bullet from his rifle, a DPMS Panther Arms Model A-15, while in his apartment. The bullet subsequently passed through the wall of a neighboring apartment and lodged in the neighbor’s mattress, according to city police. Further investigation revealed that Primarolo also possessed an unregistered Walther .380 handgun and steroids in his apartment. He was arraigned in Saratoga Springs City Court and sent to Saratoga County Jail in lieu of $5,000.00 cash, or $10,000 bond. No injuries occurred during the incident, which occurred at 2 West Ave. 

COURT

Daniel J. Guynup, 21, of Saratoga Springs, was convicted by a Saratoga County trial jury Feb. 6 in connection with a series of incidents that occurred last June in Saratoga Springs, and on Aug. 18 in the town of Corinth, according to Saratoga County District Attorney Karen Heggen. All of the charges involved one victim; the victim testified at the trial, and provided detail regarding the incidents of domestic violence.  The charges include:  strangulation in the second-degree, criminal possession of a weapon, menacing, criminal contempt, harassment, and two counts of assault. Sentencing scheduled of March 26. The defendant faces up to 7 years in prison, Heggen said.

Kristin N. Monsour-Devino, 33, of Queensbury, was sentenced Feb. 13 to five years of probation, after pleading to DWAI in Malta. 

Darin C. Dinallo, 43, of Malta, was sentenced to 1-1/3 to 4 years in state prison, after pleading to felony DWI. 

POLICE

Robert N. Rouse, 32, of Milton, was charged Feb. 18 with two felony counts of aggravated DWI-Leandra’s Law, and two misdemeanor counts of endangering the welfare of a child. He is accused of operating a motor vehicle while intoxicated and while there were two children 15 years old or younger in the vehicle with him. He was released on appearance tickets and is scheduled to appear in Greenfield Town Court, according to the Saratoga County Sheriff’s Office. 

Lazaro Martinez-Ramirez, 35, of Schenectady, was charged Feb. 18 with felony burglary, and criminal mischief and assault – both misdemeanors. He is suspected of unlawfully entering a town of Ballston dwelling and causing physical injury to its occupant, according to the Saratoga County Sheriff’s Office. He is also accused of being unlawfully present in the U.S. and turned over to ICE. The agency subsequently transported him to Rensselaer County Jail, pending removal proceedings, according to the sheriff’s office. 

Nary Bachner, 62, of Saratoga Springs, was charged Feb. 3 with misdemeanor DWI, refusal to take a breath test, and following too closely. 

Jerson Vargas, 42, of Saratoga Springs, was charged Feb. 3 with harassment in the second-degree, and disorderly conduct. 

Benjamin Weber, 23, of Saratoga Springs, was charged Feb. 2 with aggravated unlicensed operation of a motor vehicle, failure to obey a traffic control device, and registration/suspension of  motor vehicle registration. 

Holly Turcotte, 43, of Corinth, was charged Feb. 3 in Saratoga Springs with criminal contempt, and aggravated family offense, a felony. 

Zanasia Wicks, 27, of Ballston Spa, was charged Feb. 4 in Saratoga Springs with petit larceny, a misdemeanor. 

Jordan Blount, 29, of Ballston Spa, was charged Feb. 4 in Saratoga Springs with aggravated unlicensed operation of a motor vehicle, and speeding. 

Ryan Gillen, 25, of Saratoga Springs, was charged Feb. 5 with aggravated unlicensed operation of a motor vehicle, and speeding. 

Sean Richards, 35, of Amsterdam, was charged Feb. 5 in Saratoga Springs with misdemeanor DWI, criminal possession of a controlled substance, aggravated unlicensed operation of a motor vehicle, criminal possession of an assault weapon in the third-degree- a felony, and criminal possession of a weapon in the second-degree, a felony. 

Randy Jones, 53, of Saratoga Springs, was charged Feb. 5 with obstructing governmental administration,  and disorderly conduct. 

Kristen Weatherwax, 28, of Saratoga Springs, was charged Feb. 5 with offering a false instrument for filing, and welfare fraud. 

Matthew Cahn, 41, of Albany, was charged Feb. 5 in Saratoga Springs with petit larceny.

Scott Solomon, 33, of Saratoga Springs, was charged Feb. 6 with issuing a bad check with knowledge of insufficient funds. 

Mark Skojec, 47, of Malta, was charged Feb. 7 in Saratoga Springs with aggravated unlicensed operation of a motor vehicle. 

Adam Forshey, 20, of Schenectady, was charged Feb. 7 in Saratoga Springs with misdemeanor DWI and four driving/license infractions. 

Jeremy Robson, 19, of Ballston Spa, was charged Feb. 7 in Saratoga Springs with criminal mischief. 

Clifford Pierre, 37, of Hudson Falls, was charged Feb. 7 in Saratoga Springs with harassment, and disorderly conduct.

COURT

Shane P. Stephens, 27, of Milton, was sentenced Feb. 11 to 1 year in jail, after pleading to criminal contempt in the first-degree. 

Tanner M. Hatch, 36, of Greenfield, was sentenced Feb. 11 to five years of probation, after pleading to aggravated DWI. 

Jennifer C. Vandetta, 49, of Gansevoort, was sentenced Feb. 11 to five years of probation, after pleading to felony DWI, in Wilton. 

Dominick Monge, 24, of Amsterdam City, NY  was sentenced to 1.5 to 3 years in state prison, after pleading to unlawful surveillance in the second-degree, in Wilton. 

Capital Region contractors - Segundo Loja, of Albany, and Robert A. Lutz, of Ballston Spa - were arraigned last week for putting their employees at risk after allegedly failing to obtain workers’ compensation insurance coverage, according to New York State Inspector General Tagliafierro. 

Loja, owner of NY Power Construction Corporation, was arraigned in Saratoga Springs Court in connection with the charges: falsifying business records in the first-degree, failure to secure compensation, and fraudulent practices – all felonies. 

Lutz, owner of Robert’s Roofing & Remodeling, was arraigned in Saratoga Springs Court in connection with the charges: offering a false instrument for filing in the first-degree, and fraudulent practices — both felonies ­— and failure to secure compensation, a misdemeanor. 

Claude V. Campbell, 31, of Greenfield Center, was sentenced Feb. 6 to: 1 year in jail after pleading to misdemeanor DWI and felony aggravated unlicensed operation of a motor vehicle regarding charges in October in Halfmoon; 1 year in jail  after pleading to attempted criminal possession of a weapon regarding  charged in May in Malta. Sentences are to run consecutively.    

John Jerry Scott, 25, of Ballston Spa, was charged Feb. 5 with attempting to disseminate indecent materials to minors, a felony. Sentencing April 8. 

Thomas P. Allen, 29, of Valley Stream, pleaded Feb. 5 to felony DWAI in Wilton. Sentencing April 22. 

POLICE

Alexander Kotsakis, 30, of Boston, Massachusetts, was charged Feb. 9 in Saratoga Springs with misdemeanor DWI, and two driving violations. 

Eduardo Zubieta, 58, of Greenfield, was charged Feb. 9 in Saratoga Springs, with misdemeanor DWI, and refusal to take a breath test. 

Merton E. Tyrel, 27, of Ballston Spa, was charged Feb. 9 with assault in the second-degree, and endangering the welfare of child, in connection with an alleged incident that occurred in the Town of Malta. Tyrel is suspected of intentionally causing a physical injury to a child under the age of 7 by throwing her onto a bed, according to the Saratoga County Sheriff’s Office. Tyrel was sent to Saratoga County Jail in lieu of $500 cash bail, $1,000 bail bond, or $5,000 partially secured bond. 

Ezekiel West, 26, of Schenectady, was charged Feb. 2 with two felony counts criminal possession controlled substance; the misdemeanors: resisting arrest, unlawful fleeing a police officer in a motor vehicle, criminal use drug paraphernalia, and aggravated unlicensed operation; two driving violations and unlawful possession of marijuana. According to city police: at about 1:44 a.m. on Feb. 2, an officer on patrol attempted to stop a 2020 Nissan Altima in the area of Vanderbilt Avenue. Initially the Nissan failed to stop for the marked police car as they traveled on Vanderbilt, but it eventually did come to a stop on Doten Avenue. The driver of the Nissan – alleged to be Ezekiel West, subsequently took off running from the car. A foot pursuit took place through several backyards. The suspect was eventually taken into custody and allegedly found to be in possession of about 4 grams of cocaine as well as other items of paraphernalia consistent with the sale of illegal drugs. West was arraigned and $1,000 cash bail was set.

Benjamin T.M. Fedd, 41, of Schenectady, was sentenced Jan. 13 to two years in state prison, after pleading to criminal possession of a controlled substance, a felony, in Saratoga Springs. 

Robert C. Gahan, 31, of Green Island, was sentenced Jan. 9 to one year in jail, after pleading to felony DWI in Wilton. 

Dillon J. Ball, 25, of Fort Edward, was sentenced Jan. 9 to one year in jail, after pleading to an aggravated family offense, a felony, in Saratoga. 

Rebecca A. LeFevre, 44, of Saratoga Springs, was sentenced Jan. 10 to five years of probation, after pleading to felony DWI. 

Rory L. Graham, 59, was convicted Jan. 13 in absentia by a Saratoga County jury of a series of counts of an indictment regarding incidents in the town of Galway on Feb. 6 and March 4, 2019, according to county District Attorney Karen Heggen. The jury found Graham guilty of: criminal contempt in the first and second degree, two counts of aggravated family offense, aggravated harassment, and endangering the welfare of a child. Graham, who was out on bail pending trial, fled the county court’s jurisdiction prior to the scheduled court date, Heggen said. Graham was accused of violating a criminal court order or protection in place regarding his ex-wife, and of subjecting his ex-wife and daughter to domestic violence over a period of years, Heggen said.  Sentencing is scheduled March 12.

Joseph Sims, 51, of Middle Grove, was charged Jan. 11 in Saratoga Springs with felony DWI, refusing to take a breath test, and aggravated unlicensed operation of a motor vehicle.

John A. Butler, 40, of Gansevoort, was charged Jan. 13 in Northumberland with felony DWI, leaving the scene of a property damage crash, refusing to take a pre-screen test, and a variety of traffic infractions. Butler is alleged to have operated a motor vehicle on a public highway while in an intoxicated condition, and striking a utility pole on Route 50, according to the Saratoga County Sheriff’s Office. 

Jake B. Sweeney, 31, of Claremont, NH, was charged Jan. 8 with criminal possession of a weapon second-degree, a felony. Sweeney was charged following a complaint of a disturbance at the Grand Prix motel and the Round Lake Inn on Round Lake Road in the Town of Malta. He is alleged to have possessed a loaded firearm during an altercation with other unrelated people at both locations. He was held in lieu of $15,000 bail or $30,000 insurance bond, to reappear in Malta Town Court at a later date.

Keith C. Owen, 42, of Saratoga Springs, was sentenced Jan. 8 to 1 year in jail, after pleading to criminal contempt in the first-degree. 

Andrew M. Acabbo, 79, of Saratoga Springs, pleaded Jan. 8 to felony DWI.

Jaredd M. Elston, 26, homeless, pleaded Jan. 3 to assault in the second-degree, a felony. Sentencing March 6. 

Anthony Orologio, Jr., 67, of Round Lake, was sentenced Jan. 7 to one year jail, after pleading to felony DWI, in Ballston. 

Joseph P. Koren, 24, of Saratoga Springs, was sentenced Jan. 8 to five years in prison and 2-1/2 years of post-release supervision, after pleading to criminal possession of a loaded weapon in the second-degree. Koren admitted he possessed a loaded .38-cal. revolver in his neighbor’s yard on June 19, 2019, as he attempted to flee from police, and “repeatedly refused commands by city police officers to drop the revolver and keep his hands in sight,” according to Saratoga County District Attorney Karen Heggen. 

Nicholas Q. Furnia, 25, of Gansevoort, was sentenced Jan. 6 to five years of probation, after pleading to felony DWI, in Wilton. 

Elliott Q. Ruggles, 27, of Saratoga Springs, was sentenced Jan. 6 to 1-1/3 to 4 years in state prison, after pleading to felony DWI. 

Christian D. Roldan, 36, of Northumberland, was sentenced to 2 to 4 years in state prison after pleading to attempted assault in the second-degree, and one year in jail after pleading to criminal obstruction of breathing. Sentences to run concurrently. 

POLICE 

Matthew T. Washburn, 30, of Hudson Falls, was charged Jan. 5 with strangulation, a felony, after allegedly choking another person to the point of unconsciousness, according to the Saratoga County Sheriff’s Office. The incident occurred in the town of Saratoga. He was sent to Saratoga County Jail in lieu of bail or bond. 

Justin A. Peters, 29, of Milton, was charged Jan. 5 with strangulation in the second-degree, and criminal contempt in the first-degree – both felonies, and the misdemeanors: endangering the welfare of a child, and criminal mischief. Peters is accused of applying pressure to the neck/throat of another person, resulting in that person suffering a physical impairment, according to the Saratoga County Sheriff’s Office. He is also accused of violating an order of protection and preventing a person from calling 911. A minor was also present during the alleged incident. He was arraigned in Milton Town Court and released on his own recognizance. 

Alena Demarco, 21, of Saratoga Springs, was charged Jan. 3 with misdemeanor petit larceny. 

Marcus Elston, 28, of Saratoga Springs, and Neil Lescault, 45, of Mechanicville, were each charged Jan. 3 with one count criminal trespass, in Saratoga Springs. 

Aaron Edwards, 38, of Corinth, was charged Jan. 4 in Saratoga Springs with assault in the third-degree. 

Joshua Imler, 40, of Cohoes, was charged Jan. 5 in Saratoga Springs with misdemeanor DWI, and the unsafe backing of a vehicle. 

Mark Galluci, 46, of Saratoga Springs, was charged Jan. 2 with harassment, and criminal tampering.

Mickenzie Miner-Papke, 25, of Ballston Spa, was charged Dec. 30 in Saratoga Springs with unlicensed operation of a motor vehicle, and operating an unregistered vehicle. 

Audrey Hill, 51, of Glens Falls, was charged Dec. 30 in Saratoga Springs with aggravated unlicensed operation of a motor vehicle. 

SARATOGA SPRINGS –  It’s been a long and winding road to Adelphi Street since a community of residents, clergy, business leaders, politicians and everyday folks first came together to create a space where people without a home can find shelter during frigid nights, get fed a warm meal, recharge their bodies and head back out into the light of the next day to try and secure a more stable standing.

Motivated to action in the wake of the death of a city woman exposed to a winter’s elements on a December night in 2013, a temporary homeless emergency shelter was launched that Christmas Eve at St. Peter’s Parish Center.

A series of temporary winter shelters, sited at a variety of venues across town, have followed: the Salvation Army building west of Broadway and Soul Saving Station Church east of Broadway, among them. The latter, having a 41-bed capacity, required the addition of the Presbyterian New England Congregational Church also open for extended periods to care for the “overflow” of guests.

Last month, Shelters of Saratoga - which oversees the Code Blue shelter program – opened the latest temporary venue at 4 Adelphi St., just west of South Broadway. In 2016, an executive order issued by Gov. Andrew Cuomo directs emergency shelters to operate when temperatures drop below 32 degrees.

Many hands were needed to transform a previously vacant Adelphi Street warehouse into a suitable shelter space in time for the winter season.   

“On behalf of Shelters of Saratoga, I extend my heartfelt appreciation to the incredible generosity of all the businesses that helped bring Code Blue to Adelphi Street a reality,” said S.O.S. Executive Director Karen Gregory.

The locally based Bonacio Construction firm led the way, transforming the 4,000 square-foot of industrial space into accommodations for people during cold temperatures, at cost. The work included fitting up the existing building with new electrical, HVAC, and plumbing, painting floors, adding bathrooms with showers, and donating shelving.

“We worked hard to get this project on schedule after running into asbestos in the building in November,” Bonacio says. “After working through the weekends, we were able to make up valuable time and got them up and running for opening on December 9.”

“We’re very grateful to them for completing the project at cost, foregoing profit and being very generous with their expertise,” Gregory said.

During the 2017-18 winter season – the latest figures available - Code Blue was open 162 nights, served more than 8,000 meals, and provided sleeping quarters for a total of 6,480 overnight stays – or on average, 40 nightly guests.

The new location houses a 61-bed facility – many more than in previous locations - and as such, Gregory said an “overflow” shelter is not anticipated at this time.  “I think the new location is working well. We’re working with people to get them to and from different appointments they need to be at. We’re in Saratoga Springs, so realistically anywhere in the city would have worked well,” she added. 

The lease on the new location runs until November 2021. An entirely new staff and leadership has been hired providing more people than in years past working each shift, and just over 107 new volunteers have also been added this year, pointed out Gregory, who said the search for a location to host a permanent site continues. “That’s something I’m truly committed to and is something in the conversation and on my agenda every single day. Two years is going to go by quickly, so we can’t take our eye off of that. That has to be a priority on my agenda, the city’s agenda, and hopefully the county’s agenda as well,” Gregory said. 

Finding a permanent shelter location has proved to be a challenge.  A permanent shelter location was thought to be found in 2017 on Walworth Street, where a Code Blue structure would be built on property belonging to Shelters of Saratoga after local business owner Ed Mitzen, and his wife Lisa announced they would pay the costs for the new, permanent shelter to be built. In September 2018, however, following a lawsuit filed by local residents challenging the proposed shelter expansion as not being in accordance with zoning regulation, a Saratoga County Supreme Court judge nullified previously granted approvals by the city’s Zoning Board of Appeals and the Planning Board which would have allowed the shelter to be built.

Regarding the new temporary spot, the city of Saratoga Springs provided $50,000 towards the upkeep of the building as well as for paying rent in the off-season for the next two years, as well as supporting the S.O.S. outreach program.

As far as need, Gregory says the best way for people to help is to make donations directly to Shelters of Saratoga to aid in the continuation of the organization’s providing of services.

“We haven’t been reimbursed by the county or the state at all yet, so we’re carrying this tremendous financial responsibility forward,” Gregory said. “We’re not exactly sure what the county and state are going to reimburse us for and there’s always a risk of the unknown.  That makes it difficult on a small non-profit like us because we can’t afford to incur those expenses and not get reimbursed, obviously. In the interim, we have applied and been approved for a bridge loan for $200,000 by a non-profit bank just in case reimbursement continues to be prolonged. At least that would not put the agency in a tough spot and cover some of the costs, until we get some kind of reimbursement.”

Finding a long-term solution to address the city’s homelessness issue – specifically including a permanent Code Blue facility - is listed among the city’s outlook of priorities in 2020. 

“I’m so thankful to be working in this incredibly generous community - the amount of expertise and support and humanity - just coming together when there are needs and putting people first,” said Gregory, who was named executive director of S.O.S. last year.  “We really do care about our homeless neighbors, keeping them safe, and I’m very appreciate of having a community that’s so behind S.O.S. It’s been a wonderful experience so far.”

Michael L. Ross, 18, of Malta, was charged Jan. 3 with making a terroristic threat, following a complaint of a threat made via social media to students at the Maple Ave Middle School in the Town of Greenfield. Ross is alleged to have posted a video onto an Instagram chat in which he threatened harm to students at the school, and threatened to bring a firearm to the school. He was arraigned in Wilton Town Court and released on his own recognizance, and is scheduled to reappear in Greenfield Town Court at a later date.

Matthew Cosgrove, 27, of Ballston Lake, was charged Jan. 1 in Saratoga Springs with felony DWI and felony aggravated DWI – with a previous conviction of the offenses within 10 years.

Darin C. Dinallo, 43, of Malta, was charged Dec. 30 with the following:  felony DWI, felony aggravated unlicensed operation of a motor vehicle; the misdemeanors: unlawful fleeing a police officer in a motor vehicle, circumvent interlock court order- a misdemeanor, use of a vehicle without an ignition interlock device, criminal contempt 2nd disobey a court order, reckless driving, aggravated unlicensed operation, and a variety of driving related violations. According to the Saratoga County Sheriff’s Office, shortly after midnight, an off duty police officer reported a male slumped over the wheel in the area of Malta Avenue and Old Post Road in the Town of Malta. The male woke and began to operate the vehicle on Malta Avenue. Saratoga County Sheriff’s patrols located the vehicle on Van Aernem Road and initiated a vehicle stop. The vehicle failed to stop for the Deputy’s lights and siren. A pursuit ensued and terminated when the vehicle pulled into a driveway on Brownell Road. Dinallo refused a breath test, was arraigned at Mechanicville City Court and was sent to the Saratoga County Jail, without bail. This DWI charge is the 4th DWI related arrest in the previous 10 years for Dinallo, who is currently on probation for those convictions, according to the sheriff’s office.

The warrant was the result of an investigation into the occupants of an apartment. Allegedly seized during the warrant execution was a loaded 9mm Glock 17 handgun, a Cimarron 12-gauge shotgun, over $2,000 US currency, about 8 grams of crack cocaine, and other drug paraphernalia consistent with the illegal sale of narcotics. The Glock was discovered to have been stolen during the course of a burglary elsewhere is Saratoga County several months ago, according to police. Willson was sent to jail in lieu of $25,000 cash/ $50,000 bond, while both Adams and Wright were held without bail. The Saratoga County Sheriff’s Office Special Operations Team assisted Saratoga Springs Police at the scene with the warrant execution. 

Brandon Carlock, 27, of Schenectady, was charged Dec. 19 in Saratoga Springs with petit larceny. 

Jasmin Saffold, 37, of Malta, was charged Dec. 19 in Saratoga Springs with welfare fraud, a felony. 

Katie Timoney, 32, of Greenwich, was charged Dec. 20 in Saratoga Springs with misdemeanor DWI, and a speeding violation.
