BALLSTON SPA — Harness racing trainer Brian D. Allen was found guilty of having sexual relations with a 14-year-old girl and was sentenced Thursday to a determinate sentence of three years in state prison and seven years of post-release supervision.
Allen, 49, was originally indicted in June on 48 counts of sexual misconduct in relation to two Ballston Spa teenage girls (14 and 15 years old). The charges against Allen include 21 counts of second-degree criminal sexual acts and 11 counts of second-degree rape.
He had pleaded not guilty on all counts, but Saratoga County Court Judge Jerry Scarano found Allen guilty on one count of second-degree criminal sexual act and endangering the welfare of a child.
After a plea bargain was reached, Allen pleaded guilty to an additional count of second-degree criminal sexual act with the second victim and he will now be mandated to register as a sex offender.
